The Securities and Exchange Commission has named Peter Driscoll director of the agency’s Office of Compliance Inspections and Examinations.

He’s been serving as OCIE’s acting director since January, when former OCIE head Marc Wyatt departed.

OCIE directs the agency’s National Examination Program, which uses a risk-based approach to examine investment advisors and broker-dealers.     

“Pete has been an exceptional leader of the National Examination Program since taking over as acting director of OCIE, including advancing the use of technology to make the program more effective,” said SEC Chairman Jay Clayton, in a statement. “With over 15 years of experience at the SEC as an attorney, examiner, and manager, I am confident that Pete and OCIE’s dedicated staff will continue to advance the interests of investors across the country.”

As I have noted in past columns, I have been charting stocks for more than three decades, and my personal belief is that analysis of chart patterns is an essential part of sizing up the tradeoff between reward and risk for investors at any point in the market cycle.  This does not mean that so-called technical analysis should be used in isolation, and charting is not simply about forecasting winners and losers over the coming weeks, months or even years.  But, since investing is really an ongoing series of decisions among many alternative paths one can take (buying/selling/holding/increasing position size/decreasing position size), it makes sense to be eyes wide open with what the market is telling us about supply and demand pressures regarding different market segments.

    The hire illustrates the company preparing for a legal war against Uber regarding autonomous vehicles, and for policy battles regarding government affairs with Washington and around the country.

    “As we take fully self-driving cars to the roads, Tekedra will work with policymakers at all levels to realize the enormous safety, mobility and economic benefits of this technology,” CEO of Waymo John Krafcik said in a statement to Recode on Monday.

The internet portal posted adjusted diluted earnings per share (EPS) of $0.18 on revenue of $1.33 billion. In the same period a year ago, Yahoo reported EPS of $0.08 on revenue of $1.09 billion. First-quarter results compare to the consensus estimates for EPS of $0.14 on revenue of $1.23 billion.

    HP Inc (NYSE: HPQ) disclosed that it would be implementing a restructuring plan that would likely result in the firing of 3,000 to 4,000 employees, annual savings of $200 million to $300 million, and a charge of $350 million to $500 million. Management also announced a 7 percent surge in the stock’s dividend and an additional $3 million share repurchase program. The company issued its outlook for fiscal 2017, guiding for EPS of $1.55 to $1.65, mostly below the Street’s consensus of $1.64. HP shares fell 1.32 percent to $14.95 in the after-hours trading session.
    Analysts are expecting JPMorgan Chase & Co. (NYSE: JPM) to have earned $1.39 per share on revenue of $23.99 billion in the latest quarter. JPMorgan will release earnings before the markets open. JPMorgan shares gained 0.37 perecent to $67.99 in after-hours trading.
    Aerohive Networks Inc (NYSE: HIVE) reported weak preliminary results for its third quarter. The company said it expects a net loss of $(0.06) to $(0.07) per share, versus consensus at $(0.04) per share. Revenue guidance of $40 million also fell short of expectations for almost $48 million. Aerohive shares dropped 18.29 percent to $4.60 in the after-hours trading session.

    Early on Friday, analysts at RBC Capital boosted the near-term estimates on SanDisk Corporation (SNDK), a manufacturer of data storage products, because a fire at SK Hynix’s factory should lead to favorable pricing over the next two quarters.

    “We see a favorable pricing environment as a result of SK Hynix’s fire, which threatens to curtail NAND output as the company likely re-purposes production back toward DRAM, resulting in lower than expected incremental NAND wafers vs. company’s plan of 170K/WPM,” RBC Capital analyst Freedman said. “Consequently, we see stronger pricing through EoY before SK Hynix ramps NAND toward normalized prod’t levels as DRAM resources are restored/replaced.”

    The analysts maintain an “Outperform” rating on SDNK and still see shares reaching $76. This price target suggests a 26% upside to the stock’s Thursday closing price of $60.08. Furthermore, they boosted SanDisk’s 2013 EPS estimates from $4.82 to $4.95.

    SanDisk shares were up a fraction during pre-market trading on Friday. The stock is up 38.11% year-to-date.

    As much progress as the remote medical monitoring device market has made in recent years, we’ve still only scratched the surface. The surface has been scratched though. The Dexcom G5 mobile glucose monitor from DexCom, Inc. (NASDAQ:DXCM) is one impressive example. Arguably the first and best entry in the race, DexCom has sent a clear message that consumers and caregivers are ready for a functional device that takes care of itself.

    At the other end of the spectrum is a recent round of products that are less clinical in nature, and more broad-usage friendly. Devices like the Apple Inc. (NASDAQ:AAPL) watch and the Fitbit Inc (NYSE:FIT) line of products are both capable of monitoring heart rates and activity. On the other, neither does it all that well… not like one would expect in a clinical setting. Fitbit has run into a headwind of legal and reputational trouble since it’s been verified that its trackers aren’t all that accurate; Apple avoided such trouble largely because few consumers ever viewed its watches as medical-grade hardware.

    The gap between the Dexcom G5 and the Fitbit fitness trackers, however, is where real opportunity lies. See, the entries to date have proven there is a market for mobile medical devices , but have also proven they have to work as well as the equipment one might expect to find in a doctor’s office or in a hospital.

    It’s this subtle nuance that puts a young company called Biotricity Inc. (OTCMKTS:BTCY) in the spotlight, as it has melded mobile monitoring and quality monitoring, and is now in the midst of making sure they’re marketable… not just to consumers, but to insurance companies (which tend to pay a lot more than the average consumer does). Fitbit missed the mark on both fronts.
